(National SentinelDiscipline: Attorney General Jeff Sessions is reviewing an internal review of outgoing FBI Director Andrew McCabe by the Justice Department that recommends he be terminated instead of allowed to retire on full benefits.

As reported by The New York Times, McCabe is set to retire on Sunday, giving Sessions just a few days to decide his ultimate fate.

The paper noted:

Mr. McCabe is ensnared in an internal review that includes an examination of his decision in 2016 to allow F.B.I. officials to speak with reporters about an investigation into the Clinton Foundation. The Justice Department’s inspector general concluded that Mr. McCabe was not forthcoming during the review, according to the people briefed on the matter. That yet-to-be-released report triggered an F.B.I. disciplinary process that recommended his termination — leaving Mr. Sessions to either accept or reverse that decision.

The Times noted further that while no decision has been made as of yet, some sources inside the DoJ said that Sessions was leaning towards firing McCabe before Friday, which would endanger his pension as a 21-year veteran of the department.

President Donald J. Trump, who has been highly critical of McCabe and has blamed him for his role in misusing the Foreign Intelligence Surveillance Court to improperly spy on his 2016 campaign, clearly would like to see him fired.

He tweeted on Dec. 23: “FBI Deputy Director Andrew McCabe is racing the clock to retire with full benefits. 90 days to go?!!!”

That could be seen as a signal to Sessions that the president does not want McCabe to retire unscathed.

Fox News legal analyst and attorney Gregg Jarrett has said he believes McCabe and other Obama-era FBI and DoJ officials could be in legal jeopardy over their involvement in the Trump campaign spying.

Rep. Louie Gohmert, R-Texas, a former state judge, has said he believes McCabe and the others should be jailed for “FISA Court fraud’ — specifically, for using the bogus “Trump-Russia dossier” to obtain a warrant to spy on Trump campaign manager Carter Page.

The House Intelligence Committee said the FBI misrepresented the opposition research document paid for in part by the Hillary Clinton campaign as a legitimate intelligence document when it was not.

McCabe has been the subject of an investigation by the Justice Department’s inspector general’s office over allegations the FBI was politicized to cover for and exonerate Clinton over her mishandling of classified emails and to undermine Trump’s candidacy and his presidency, according to the House Intelligence Committee’s FISA memo.
