Federal appeals court UPHOLDS Texas anti-sanctuary city law

(National Sentinel) Lawful: A federal appeals court has upheld a Texas law that bans so-called “sanctuary cities,” jurisdictions that have adopted policies shielding illegal immigrants from federal immigration authorities.

A three-judge panel of the 5th U.S. Circuit Court of Appeals in New Orleans ruled that the state’s current immigration enforcement laws are constitutional and proper.

Earlier, lawmakers in the state enacted Senate Bill 4, which allowed local law enforcement officers to question the immigration status of people they have in custody, The Texas Tribune reported.

However, a part of the legislation remains on hold. A provision that punishes local government leaders or elected officials who do not cooperate with federal immigration officials, like recent actions taken by the mayor of Oakland, Libby Schaaf, has not yet passed muster with the appeals court.

Earlier this month, Schaaf tipped off her community to a secret operation by Immigration and Customs Enforcement (ICE) aimed at rounding up illegal aliens in the area, with a focus on those who have been convicted of crimes.

Texas Gov. Greg Abbott said in a tweet following the ruling that “Allegations of discrimination were rejected” and the “Law is in effect.”

“It is lawful, constitutional, and protects the safety of law enforcement officers and all Texans,” Texas Attorney General Ken Paxton added in support of the ruling.
